1. Agreement to Terms [LEGAL REVIEW REQUIRED]
By accessing or purchasing from cozyvora.com ("Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use or access our services.
2. Products, Pricing & Payment [LEGAL REVIEW REQUIRED]
All orders are subject to acceptance and availability. Prices displayed on our Site are in Indian Rupees (INR) or localized currency including applicable taxes. Payment transactions are processed securely via RBI-licensed third-party payment aggregators including Razorpay and PayPal. We do not store sensitive payment card details or net banking credentials.
3. Data Protection, Privacy & Consent (DPDP Act, 2023)
3.1 Incorporation of Privacy Notice: Your use of the Site and submission of any personal data is governed by our Privacy Notice, which is incorporated into these Terms by reference. By providing personal data, you acknowledge that you have read and understood our processing practices.
3.2 Consent for Transaction Execution: You acknowledge that the collection, storage, and transfer of your personal data (including name, billing address, shipping destination, phone number, and transaction identifiers) to logistics, warehousing, print-on-demand fulfillment partners (such as Qikink), and payment gateways is necessary for the performance of our contract with you.
3.3 Duties of the Data Principal (Section 15): In accordance with Section 15 of the Digital Personal Data Protection Act, 2023, you warrant and agree that:
- You will not impersonate any other person while providing your personal data;
- You will not suppress any material information while providing personal data for any document, unique identifier, or proof of identity;
- You will not register a false or frivolous grievance or complaint with CozyVora or the Data Protection Board of India; and
- You will provide only verifiably authentic and accurate personal data when exercising your statutory rights or placing orders.
3.4 Consent Withdrawal & Service Limitations (Section 6(4)): You retain the statutory right to withdraw your consent to personal data processing at any time. However, you acknowledge and agree that where the withdrawal of consent impairs our ability to fulfill pending orders, process returns, issue statutory tax invoices, or provide customer support, CozyVora reserves the right to cancel or pause the affected transactions without liability for non-performance.
3.5 Security Measures & Limitation: CozyVora implements reasonable technical and organizational safeguards to protect personal data against accidental loss, unauthorized access, or disclosure. In the unlikely event of a personal data breach, CozyVora will notify the Data Protection Board of India and affected users in strict compliance with Section 8(6) of the DPDP Act and our published Breach Response Protocol.
3.6 Grievance Redressal: Any complaints concerning the processing of personal data must be directed to our designated Grievance Officer at support@cozyvora.com, who will resolve issues within thirty (30) days.
4. Shipping & Delivery [LEGAL REVIEW REQUIRED]
Delivery timelines are estimates and subject to carrier operations. Title and risk of loss for products pass to you upon our delivery to the courier carrier.
5. Returns and Refunds [LEGAL REVIEW REQUIRED]
Returns, replacements, and cancellations are governed by our Store Return Policy. Approved refunds are credited to the original payment source within 5 to 7 business days following receipt and inspection of returned items.
6. Governing Law & Jurisdiction [LEGAL REVIEW REQUIRED]
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Subject to the dispute resolution provisions of the DPDP Act, 2023 for data protection matters, the courts of Bengaluru, Karnataka, India shall have exclusive jurisdiction over all disputes arising under these Terms.
