These Terms of Service (“Terms”) govern your access to and use of cozyvora.com (the “Site”) and any purchases you make through the Site. By accessing the Site or placing an order you agree to these Terms. If you do not agree, do not use the Site or place an order.
1. Definitions
1.1 “CozyVora”, “we”, “us”, or “our” means CozyVora, the operator of the Site, and its brand operations.
1.2 “You” or “your” means the person or entity ordering products or using the Site.
1.3 “Order” means a purchase of products placed through the Site.
1.4 “Products” means the goods listed for sale on the Site.
1.5 “Processing network”, “production network”, “logistics network”, and “shipping system” refer to CozyVora’s operational and service arrangements for producing, handling, and shipping orders.
2. Eligibility
By using the Site and placing an order, you represent that you have the capacity and authority to enter into a purchase agreement under applicable law. If you are placing an order on behalf of a minor or another person, you confirm that you have the legal authority to do so and accept these Terms on their behalf.
3. Account & Information
3.1 When you create an account or place an order you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify support@cozyvora.com immediately of any unauthorized use.
4. Order Acceptance, Processing & Production
4.1 Order acceptance occurs when we confirm receipt of payment and commence order processing. We may refuse or cancel any order at our discretion (for example, for payment failure, suspected fraud, or policy violations).
4.2 Orders are processed through our processing network. Processing typically takes 1–3 business days after payment confirmation. Once an order has entered production it cannot be cancelled.
4.3 We make commercially reasonable efforts to fulfill accepted orders; however, production and shipping times are estimates and are not guaranteed. If we cannot fulfill an order, we will notify you and provide available remedies.
4.4 Custom Print Requests & Design Specifications
(a) CozyVora primarily offers Products featuring our curated designs. Custom print requests may be accepted on a case-by-case basis and are subject to approval.
(b) If you submit custom designs or artwork for printing, you represent and warrant that:
- You own all rights to the design or have obtained all necessary permissions and licenses
- The design does not infringe any intellectual property rights, including copyrights, trademarks, or patents
- The design does not contain unlawful, defamatory, obscene, or prohibited content
- The design complies with all applicable laws and regulations
(c) You are responsible for ensuring custom design files are high-quality and suitable for printing at the intended size and on the selected product. CozyVora is not responsible for poor print quality resulting from low-resolution, incorrectly sized, or improperly formatted files provided by you.
(d) If a custom design does not fit the selected product dimensions or is not compatible with the intended printing method, we may automatically adjust the print size (typically by 0.5 to 1 inch) or substitute an alternative printing method to ensure proper production, without materially altering the design intent.
(e) By submitting a custom design order, you accept these potential adjustments as part of the production process and acknowledge that minor variations may occur.
(f) CozyVora reserves the right to refuse any custom print request that violates these Terms, infringes third-party rights, or contains content we deem inappropriate or unlawful. Refused custom orders will be cancelled and refunded.
5. Product Information & Availability
5.1 We endeavour to describe Products accurately. Images, descriptions, measurements and colours are provided for reference; minor variations in colour, print, or dimensions may occur and are not defects. Industry-standard tolerances for apparel measurements are ±0.5 inch; such variations are not considered defects or grounds for return.
5.2 Product availability and pricing on the Site are subject to change without notice. We reserve the right to limit quantities or refuse orders.
6. Pricing, Taxes & Duties
6.1 Product prices are displayed on the Site. All payments must be made in full before an Order is processed.
6.2 Prices do not include applicable local taxes, duties, or import fees for international shipments. For international orders, customers are responsible for all import duties, taxes, customs clearance fees and similar charges levied by local authorities.
6.3 When paying with international payment providers (for example PayPal), the charged currency and the applied exchange rate are determined by the payment provider and your card issuer; CozyVora is not responsible for conversion fees charged by payment processors.
7. Payments
7.1 We accept payments via the methods displayed at checkout. Domestic payments may be processed via Razorpay (debit/credit cards, UPI, net banking) and other local methods. International payments are processed via PayPal and supported card rails.
7.2 All payment information is handled by the payment provider; CozyVora does not hold your card details. Charges appear on your statement as noted by the payment provider.
7.3 CozyVora is not responsible for payment gateway fees, currency conversion charges, international transaction fees, or any charges levied by your bank or card issuer. Failed or declined payments may result in order cancellation. Chargebacks or payment disputes must follow the payment provider’s dispute resolution process; CozyVora will provide necessary documentation upon request.
8. Shipping & Delivery
8.1 Shipping terms are governed by our Shipping Policy, available on the Site. In summary: processing is typically 1–3 business days; domestic delivery generally 2–5 business days after dispatch (rush options may be available for select products); international delivery typically 6–12 business days depending on destination and customs.
8.2 All shipping estimates are approximate. Delays caused by customs, carrier disruptions, remote destinations, or events beyond our control (as described in Section 17) are not the responsibility of CozyVora.
8.3 Customers are responsible for providing complete and accurate delivery information. Incorrect or incomplete addresses may result in Return to Origin (RTO) and additional charges.
8.4 Rush Processing Limitations
- (a) Rush processing may be available for select products and is subject to capacity and production schedules.
- (b) All-Over Print (AOP) products cannot be processed as rush orders.
- (c) If rush processing is unavailable after payment, rush fees will be refunded, but standard processing times will apply.
- (d) Rush orders, where available, are prioritised during processing; however, rush processing does not guarantee delivery within a specific date. Refunds apply only to the rush fee when rush processing is not met.
9. Returns, Refunds & Claims
9.1 Returns and refunds are governed by our Returns & Refunds Policy, which is available on the Site and forms part of these Terms. In summary: claims for damaged, defective, or materially incorrect items must be submitted within 7 days of delivery with the required evidence (including an unboxing video, photographs, and order details).
9.2 For approved defect/damage claims, CozyVora covers return shipping. For customer-caused issues (incorrect address, refusal to accept delivery, size preference), return costs and re-shipment charges may apply. RTO orders are not automatically refundable; if you decline re-shipment, refunds will be issued after deducting courier RTO penalties and any non-recoverable logistics costs.
9.3 Lost-in-Transit Claims
- (a) Claims are processed after carrier confirmation of loss.
- (b) Refunds or replacements for lost shipments are limited to the order value (the amount paid for the products), as this represents the maximum recoverable amount from carriers.
- (c) Carrier investigations may take time; we will keep you updated throughout the process.
10. Intellectual Property; Brand Protection
10.1 All content on the Site — including the CozyVora name, logos, designs, images, text and other brand assets — is proprietary to CozyVora. CozyVora expressly reserves all rights in and to these brand assets irrespective of any formal registration status.
10.2 Unauthorized use of the CozyVora name, logos, product images, metadata, or any content intended to trade on or dilute our brand identity is prohibited. This includes use in product listings, search metadata, advertising, tagging, or any online/offline material that could mislead consumers or search engines. CozyVora may pursue takedown notices, marketplace complaints, and legal remedies to prevent misuse. Report suspected misuse to business@cozyvora.com with supporting documentation.
10.3 Nothing in these Terms grants you any rights in CozyVora intellectual property.
11. Prohibited Uses
You agree not to use the Site or Products for unlawful purposes or to infringe the rights of others. Prohibited activities include, but are not limited to: trademark misuse, scraping content for resale, fraudulent activity, or listing CozyVora assets to misrepresent affiliation.
12. Third-Party Services & Links
12.1 The Site may contain links to third-party websites or services. We do not control third-party sites and are not responsible for their content or policies. Links do not imply endorsement.
12.2 Some orders may rely on our logistics network or third-party carriers and service providers. We will not disclose service providers’ names except where necessary; however, such third-party services remain subject to their own terms.
13. Limitation of Liability
13.1 To the maximum extent permitted by applicable law, CozyVora’s total liability arising out of or related to these Terms, the Site, or any Order is limited to the total amount you paid for the specific Order giving rise to the claim.
13.2 In no event shall CozyVora be liable for indirect, incidental, punitive, special, or consequential damages, including lost profits, lost data, or business interruption, even if CozyVora has been advised of the possibility of such damages.
13.3 Some jurisdictions do not permit limitations on liability; to the extent local law applies, these limitations shall be enforced to the maximum extent permitted.
14. Warranty Disclaimer
14.1 THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
14.2 CozyVora does not warrant that product descriptions, colors, or specifications will be perfectly accurate in every instance. Minor variations as described in Section 5 are inherent to the production process.
14.3 Some jurisdictions do not allow exclusions of implied warranties; to the extent applicable law prohibits such exclusions, these disclaimers apply to the maximum extent permitted.
15. Indemnification
You agree to indemnify, defend and hold CozyVora, its officers, agents, affiliates and service providers harmless from any claim, demand, loss, liability, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your misuse of the Site or Products.
16. Disputes; Governing Law; Jurisdiction
16.1 These Terms and any disputes arising under or in connection with them are governed by the laws of India.
16.2 To the fullest extent permitted by law, you agree that any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts located in Kolhapur, Maharashtra, India, or to arbitration if mutually agreed. You agree to first attempt resolution by contacting business@cozyvora.com.
17. Force Majeure
CozyVora will not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, government actions, strikes, labor disputes, war, terrorism, civil unrest, supply chain disruptions, raw material shortages, carrier disruptions, utility failures, or other unforeseen events.
18. Privacy
Your use of personal data is governed by our Privacy Policy. By using the Site, you consent to collection and use of information as described in our Privacy Policy.
19. Changes to These Terms
We may modify these Terms at any time. When changes are material we will post a notice on the Site and update the effective date. Continued use of the Site after posted changes constitutes acceptance of the revised Terms.
20. Account Termination and Suspension
20.1 CozyVora may suspend or terminate your account and refuse service if:
- (a) You breach these Terms
- (b) You engage in fraudulent, abusive, or illegal activity
- (c) You misuse the Site or violate intellectual property rights
- (d) Your payment method is declined repeatedly
- (e) We determine, in our sole discretion, that termination is necessary
20.2 Upon termination:
- (a) Your access to the Site and account will be revoked
- (b) Pending orders may be cancelled without refund
- (c) You remain liable for any outstanding obligations
- (d) Sections relating to intellectual property, liability, indemnification, and dispute resolution survive termination
20.3 You may close your account at any time by contacting support@cozyvora.com. Closure does not relieve you of obligations for pending orders or past conduct.
21. Severability
If any provision of these Terms is found to be unenforceable under applicable law, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
22. Assignment
CozyVora may assign or transfer its rights and obligations under these Terms without restriction. You may not assign your rights or delegate your obligations without prior written consent from CozyVora.
23. Electronic Communications
By using the Site, you consent to receive electronic communications from CozyVora. Electronic notices shall be deemed given when sent to the email address you provide.
